            This used to be the case prior to LBJ's 1964 Civil Rights Act bill that stopped this. In fact, many first year law students will say it's unconstitutional in that it eliminates freedom of choice and association for private business. The libertarians back in the '60s like Barry Goldwater (1964 Republican nominee for president) only wanted desegregation and end for discrimination for public places that were government funded like public schools, public libraries, state and federal buildings, etc.
