The title is irrelevant. The rematch clause has nothing to do with titles. If Wilder wins the legal case, then Fury would have to fight him next whether or not he has the title or not.

Same scenario when Fury had to honor a rematch clause to Klitschko or fight IBF mandatory Czar Glazkov. Fury had to drop the IBF title because he was legally tied to a Klitschko rematch.
