Because it can take weeks for all of the facts, medical information, testimony, etc to be analyzed and ruled upon.
If an unexpected time sensitive medical issue arises, there's no way to get a TUE in advance. The DCO doesn't have the authority to make a ruling and it would be idiotic to expect a binding decision to be made in the heat of the moment.
Retroactive TUE exists so proper protocols can be followed to determine if the use was legitimate. That takes time. If somebody is ill or dehydrated, you can't expect them to wait two weeks for a ruling before they seek treatment.
Standard procedure is to seek treatment immediately, submit the medical information, have a hearing or investigation, and then a ruling is issued after the fact if the treatment was legitimate.
