If you ordered it with a credit card or a debit card, just notify the company and they will refund the purchase and get the money back from Vargas later.
Did you go to him personally and order it or did you do it online at a store he owns or what? Thats foul if he ignored 12 emails, I doubt he has thousands of customers either.
Thats pretty bad customer service but just report it.
