This is an update:

According to police, cops got a call at 3:14 a.m. from Dunia Francisco, Gamboa's wife, who was crying.
Francisco was trying to leave the house because she felt Gamboa was cheating on her, she told police. The couple began to argue, when Francisco told Gamboa that she was taking their young son with her.
That's when Gamboa allegedly grabbed his wife's arm and then the back of her neck to stop her, the arrest report stated. Police said she had several scratches and redness on her arms and neck from the incident.
Gamboa admitted to police he tried to stop his wife from taking their son, and he was arrested.

Well if he admitted to that, if the cops/D.A. really want to be nasty, they could charge him with "false imprisonment" in addition to domestic violence.

She tried to leave and he kept her there with force against her will.
He admitted to this. False imprisonment--confining someone against their will.

Should have kept his mouth shut when confronted by the police instead of admitting what he did.
