Floyd makes his own decisions regarding when and whom he fights, so I say yes.
HBO couldn't force Floyd to fight Pacquiao without the drug testing, so that should answer your question right there.

Floyd Jr is his own boss officially but unofficially we do know that his boss is Al Haymon.
Oscar De La Hoya is his co promoter and without Goldenboy Promotions he couldn't make those pay per view numbers he has done.
