LOS ANGELES – A $10 million lawsuit against Manny Pacquiao’s foundation has been dismissed, according to a statement by Pacquiao’s legal counsel, Hobson Dungog + Davis LLP.
On December 14, 2010, the plaintiff RBM Group International dropped its lawsuit against Congressman Pacquiao’s foundation after failing to defend the legitimacy of the complaint.
According to the statement, Attorney Rafael Bernardino, Jr. filed a motion in the California Superior Court for the County of Los Angeles, challenging the legitimacy of the complaint filed against Congressman Pacquiao and his foundation, the Emmanuel Pacquiao Foundation. Rather than defend the legitimacy of its complaint against the Foundation, the plaintiff dismissed its complaint.
Bernardino said he is moving to dismiss the complaint against the Sarangani Congressman’s because there are no allegations specific to Pacquiao.
The hearing on Pacquiao’s motion to dismiss the complaint is scheduled for March 23, 2011.
The lawsuit stems from a failed record deal with Pacquiao. RBM Group alleges it paid Pacquiao $40,000 in 2009 to record 12-songs for an album. Pacquiao claimed he was due $160,000 up front but only received $40,000 so he never recorded the tracks.
