If Vitali is good to fight, he's good to fight. For the 3rd time now, James Toney is not so formidable an opponent that he needs to be avoided.
As far as the Toney and Vitali negotiations go, Shelly Finkel acknowledged in an interview that Toney IS willing to take a smaller part of the purse, but that they were too far along with the Maskiev fight.
I'll take his word for what he says directly in an interview.

I've told you MANY times that IF Vitali were to fight the 3 other title holders and Toney, Ruiz is the only one I think he'd most likely beat. The other fights are up in the air.
Your insistance that hypothetical match ups are dire and meaningful only underline what a deluded Klitschko Nut Hugger you are.
