they could have easily started then,

I still think there is a difference as to whether or not the option is even present does it still constitute a refusal in the sense that

1. you are aware of the situation
2. knowing this situation you choose not to

But he can offered or demand that OST test in his 40 fights but he didn't because he's hiding something, and he only demanded that test after he washed-out all the drugs in his system during retirement.
