I read most of the complaint the strongest parts are against Floyd Sr, but alot of it is subjective, i mean its hard to differentiate between opinion and malicious slander. For example, Point 29 about "best enhancing drugs" never mention Illegal drugs. It could be legal drugs that are enhancing. Point 31 is probably one of the few strong parts of the complaint when it discusses and uses the word "illegal" by Floyd Sr.
The part on GBP is quite weak. Because GBP Schaffer didnt say it in public but in a private meeting and it can be interepeted as opinion. GBP has a vested interest in Pacman, they can do alot in the verified answer to clearly demonstrate that pac is a commodity to them and they wouldnt slander one of their own commodities that they make a percentage of money from. In addition, DLH just mentioned why not do the tests if you have nothing to hide? Once again that is in itself is not slanderous.
The GBP people can get their own medical experts to counter the argument that testing clean for 15 years is trivial since the NSAC standards are not the best testing methods and that people who have passed the NSAC tests later have been found to be taking PEDS as Mosley.
We don't see alot in damages or losses to pacquiao. Did he lose endorsement deals? Has he had awards taken away from him? Ad Homenin attacks that people are jealous have no legal merit, can they prove that DLH opinion was envy? The man is a multimillionaire and is going to slander Pacquiao a man who DLH makes a profit from? Presposterous.
I just got back, so I skimmed the complaint. I do think there is a stronger case againt FLoyd Sr and Roger, but that in itself is not going to be even close to a motion for summary judgment.
Leaking false stuff to the media as what the complaint suggests might be actually one of the few strong parts of the complaint. I dont know if they are true or false, but if GBP did thown out false stuff about the contract than it could be damaging to them.
I will say that i am glad that the lawsuit did happen. Because I had wondered why he never did it before? I have done Verified Anwsers to Summons and COmplaints and I think the GBP and Mayweather legal team wont have much trouble in replying to this within 30 days.
But they may settle or ask for an extension of time. I sued my former boss for Discrimination who made $3 Million a year in Securities Law and his own words sealed his fate during a labor hearing. He settled because he put himself in a hole. I don't think GBP will settle quick on this and actually fight this and maybe counter sue.
Personally, I will love for the case to go full course. I will like to see Bills of Particular, Omnibus Motion, Depositions, and Interegatories. Have discovery documents and have Roach and Arum under oath. I will say Hats off to Roach if he states that "he never gave any illegal PED's" to any of his fighters. BTW, there is alot of leverage in those depositions. There are not fun, because there are two parts. One part is alot of personal info to check your character and some questions are embarrasing. Than the 2nd part deals with the actual complaint. Mayweather Sr does have a history with the law and it wont look good when he gets deposed.
