Could Cotto take Marg to court ?

Could Cotto take Marg to court and try to claim damages even though there is no evidence to suggest he used plaster in their fight? it must be a possibility, especially if Cotto gets beat badly Pacquiao, he could claim that, that fight took too much from him etc.
