      Here above are the articles. AP and UP etc.

      Note the words “DEMPSEY WON”.

      The verdict was appealed the next year and the appellate judge threw the case back for RETRIAL. Within that appellate judges ruling was an analysis of what charges the plaintiff could potentially reclaim IF THEY WON THE RETRIAL as well as the charges they could not reclaim.

      I have not found anything in any newspaper search regarding the retrial. I do not believe there was a retrial.

      More than likely they settled out of court as I am sure neither party wanted another expensive court case. The $ the plaintiff could reclaim was greatly reduced by the appellate judges decision.

      It’s very important to read the appellate judges ruling in its entirety and not pull snippets just to further an erroneous claim. The appellate judges ruling was that the case should be retried. His analysis of the sums that could or could not be reclaimed was just that, a legal analysis. It was NOT to render any verdict upon Dempsey. That would have occurred had the case been retried and if the plaintiffs won.
