It was reported earlier today by Boston Globe sports writer and BoxingScene contributor, Ron Borges, that WBA heavyweight champion John Ruiz is suing James Toney over Toney's use of steroids in their championship bout which took place in the first quarter of 2005.

As most remember, Toney won a 12 round decision over Ruiz on route to capturing the WBA heavyweight championship. Ten days later the title was returned to Ruiz, following Toney testing positive for steriods. 

Ruiz is seeking $10 million dollars in damages. The main claim is that Toney's use of steroids caused Toney's "energy, aggression and strength levels were unusually high in comparison to his apparent (lack of) physical condition."

Ruiz is claiming that his loss to Toney damaged his ability to earn money and hurt his reputation. Ruiz did not have the best reputation prior to the bout, but his lawsuit claims that he suffered a loss that he would not have suffered if Toney had not used an illegal steroid.

Some experts have said that Ruiz's case may be the first of it's kind, which is a lawsuit filed by one athlete, against another athlete, over the use of illegal steroids.

Ruiz is also claiming defamation of character, over comments made by Toney in recent media press releases.
