Oquendo was the driver, and neither of two were wearing helmets or other means of protection.

On Saturday, Oquendo sent a message to his girlfriend and his friends, regarding the tragedy. Oquendo could face criminal charges over the accident, since the ATV was being driven on road were these type of vehicles are not permitted and neither party wore protective helmets as required by law.

"Thanks to everyone for giving me the support that they have always given me... but at this moment my soul hurts and I don't know what is going to happen with me from this point forward. Melanie, I am sorry that your life had to end in this manner, but I hope that God will help me understand as to why you went away. I will never stop loving you and you will always be in my heart. Melanie, I loved you and... I will always love you... I have never known a woman like you in my entire life. Although you have gone away physically, you are still in my heart."
