The Albuquerque Tribune reports that Johnny Tapia will not be charged by police with cocaine possession, at least for now.

Tapia was recently hospitalized after a drug overdose on March 12. Albuquerque police said that there would be legal consequences for Tapia's overdose after a white substance was found in his Northeast Albuquerque hotel room and later identified as cocaine. Tapia was in critical condition, but managed to pull through and checked out of the hospital on March 16. The overdose came two weeks after his farewell bout that saw him stuggle to a majority decision over unknown Evaristo Primero, who was a last minute replacement.

A police spokeswoman told the paper that it's up to the District Attorney's Office to decide whether it wants to pursue a grand jury indictment

"It's still pending, and, as far as I know, we're sending it over to the District Attorney's Office," said Trish Hoffman, an Albuquerque police spokeswoman. "It's up to them to decide whether they want to pursue charges."
