    Absolutely pathetic.

    Last I heard, there were only 724 operational abortion clinics within the United States. But to listen to the way these misogynistic conservative ****s rattle on about it, you'd think there was an abortion clinic on every street corner in America.

        My con law is rusty, but I'll make a go at it.

        This bill might violate substantive due process rights under the 14th Amendment. Pursuant to Planned Parenthood v. Casey a law is unconstitutional as an undue burden on a woman’s right to an abortion before fetal viability, if the law places a substantial obstacle in the path of a woman seeking to exercise that right. Casey overruled, or re-wrote, the Roe v. Wade trimester system. The only part that seems unconstitutional is that it says that after 20 weeks, a woman can no longer have an abortion. The precedent set in Casey says that the state does not have a legitimate interest in a fetus until after it is viable. Viability is not limited to a pre-set amount of time, as fetuses develop at different rates. Pre-viability, the state cannot infringe on a person's substantive due process rights, it can only regulate under the undue burden test. Under the undue burden test, a state can try to persuade not to have an abortion, as long as it does not impose an “undue burden” Therefore, trying to limit or set the "cut-off" date at 20-weeks would be unconstitutional and against Casey. It virtually reinstates the Roe holding, which is outdated and antiquated (especially scientifically), hence why Casey refined the trimester system, or eliminated it.

        Furthermore, one could challenge the constitutionality because Casey also articulated that a state can outright limit/ban abortions post-viability, BUT it must reserve the option for an abortion when there is a medical emergency (i.e. the life of the mother is at risk). If this aspect of Casey is not met then this bill is unconstitutional. The article doesn't say anything regarding this critical issue.

        Aside from that, I think the bill is good. Politically, I don't think its the best maneuver, but it is Tejas.

          What happens in a couple of years when all of these low income families who usually vote democrat start repopulating the state? What a bunch of idiots.

            instead of ethnic cleanings they are trying to promote ethnic growth of the white communites, might be a reach but maybe they trying to up the white population, whites get abortions at a higher percentage rate then any other ethnic group and minorities are reproducing 5 to 1 (at least for children under 5 years of age), which means in 20+ years minorities will be the majority of the country's youth population and couple that with the fact that more whites are dying then are being born might be fuel and motivation enough to try and bottleneck the this dramatic demographic changes that are going to happen in the next 20 years. These are just the hard facts.
