How would driving conditions play into it? Can it be argued that the city/state/DOT didn't maintain the roads safely enough? There was no state of emergency declared so nobody was forbidden to be on the roads at the particular time.
It would, but the argument is gonna be "why were other cars on that same road able to safely drive in those conditions"?
I'd probably have it at 80/20. 80% on the semi. Maybe even 90/10.
You gotta remember, insurance companies will do whatever they can to save a buck and if they see a way out of paying 100% of a claim, they'll do it.
