Default DAMN! Indiana cops OWN fat guy who won't get out of car!




SMH... Cops have every right to check suspects at a stop for weapons for both parties safety. This guy had his kids in the car. All he had to do was get out of the car, and let the cops run check him for weapons, run his information to make sure he had no warrants, and they'd be on the way.

there is nothing in the constitution that says that, in fact the constitution says the exact opposite.

just recently in Seattle the police argued that recent accountability laws put them in danger and this was unconstitutional. the judge found that their arguments had nothing to do with the constitution, dismissing the case.

120 police officers have to have a judge tell them what is and isn't constitutional, kinda disguting.

It's not a search and seizure for an officer to pat you down for weapons. Look up Terry Stop. Anytime you are legally detained by the police (here for a traffic violation), the cops do not need probable cause to perform a "quick pat down" for weapons.

ALl they need is reasonable suspicion to perform a quick pat down for weapons. Here, this was satisfied because the gentleman was reaching around, would not get out of the car when asked. The totality of the circumstances here certainly justified reasonable suspicion. This is a much lower threshold requirement than probable cause.

When he refused to obey, he was at this point obstructing justice, thus giving the police the necessary probable cause to make an arrest.

You need to learn the difference between reasonable suspicion, and probable cause. And what gives rise to each, and how often, reasonable suspicion gives way to probable cause, and then gives way to arrest.

a police officer has no constitutional guarantee of safety. while most laws that provide them with that guarantee are unconstitutional.
