legally speaking there is no crime ayus sa basic legal maxim na "nullum crimen nula poena sine lege". walang batas na nagpaparusa sa pagvideo ng sex kya walang kulong.

isa pang argument e dahil ang video ay nirecord 2 years ago and katrina halili only cried foul when it went public. her supposed hurt and anguish came from the public display of the sex video but before such was made public she was ok and allegedly she knew the existence of such video before it became public therefore it must be the person who caused the distribution of the video that katrina must go after.
