John Wayne Gaci made money selling his paintings from prison.
Once he was found not guilty, he can't be tried again. So aside from the civil suits (which have been and gone and can't be revisited) he's essentially untouchable now. Plus, isn't he serving life in prison now anyway? What are they going to do, give him life again?

additionally, as a one of a kind item, if the price is considered competitive (usually signaled by a lot of interest,) it's sale at 5 million will set a precedent for it's value.
you don't burn purchases like that. you get it insured (not a huge expense) and you store it safely, the way you'd do with a piece of artwork, or what have you.
it's a bit different when you're buying the OJ knife, but it's still THE oj knife, and it sold for five million.
