Without the wife being convicted of murder the will was always going to stand. To overturn the will you would have to prove that Gatti was mentally ga ga. He was a young man this is not a case of a senile blind bed ridden old man being forced to sign a last minute death bed will where there is medical evidence and witnesses to support the case.
The judge may well have suspected that all was not right but without hard evidence the presumption in the law is that the last will is valid and stands. When he signed that will and his wife knew about it he set up the motive and chain of events that lead to him being murdered. Only if she gets found guilty of murder will the will be overturned and by then all the money will be spent and gone. I feel for his family they have lost a son in a horrible way and run up huge legal fees trying to correct things. Not only did she most likely kill him but she bankrupted his parents with the legal fees and family at the same time.
