Does anyone know how to deal with them?

Daughter #1 had an accident back in April when a tow truck hit her. They assumed blame no problem, but now it's time to settle and I can't get a decent offer from them. They don't want to pay the medical bills straight up, they want me to pay them.

Is there a formula of some sort to determine a fair and equitable settlement.
I have to add the fact that though the accident did not cause one of her injuries (her shoulder injury) it did aggravate it. I don't want to be unfair, but I don't think what they are offering is fair and the second offer came up a bit, but not much.

Any suggestions other then getting a lawyer??

So the truck hit your daughter's car. Was there a police report? Did you contact their insurance company directly?

I've never had any good dealings with insurance companies. They're scumbags.

Yes, the tow truck hit her. He ran a stop sign. They contacted me just as I was going to contact them. The tow truck shop owner gave my ins. company crap as to how to get in touch with his ins. co. at first, but finally relented the info. Keep in mind, my ins. company can't really deal with this much since all we carry is liability only on the red van. Wishing now I had added comp and coll. after the April accident.

The accident she had the other day is in dispute until the police report comes in.

hell no! there's plenty of law firms that won't charge you until you settle and they won't take the case until they've evaluated it and determined that there's a damn good shot at winning it.

why deal with the headache of fighting an insurance company?

Sorry, Allison....forgot the first Q.

The police did NOT come to the scene, we filed the report the following day because I ended up taking her into the ER a few hours after the accident. They generally don't come to the scene if the vehicle is drivable. They also gave daughter a hard time at the station, which pissed me off, but they did take the report. I don't know if he was cited for running the stop sign or not, but he did run it, and his company took repsonsiblity and paid to fix her van.

You have a point. Have a call into one now, waiting for a callback.
I just wanted to avoid the cost of an atty, even for the ins. co.
Keeps the rates down overall. Oh well.

May need to hire a private investigator for the recent accident if the police report is inconclusive.

Daughter says she had the green light, other girl says she had the green arrow. You HAVE to trip the arrow at this intersection and you always have to stop before it turns green. Daughter was coming from opposite direction and had the green light. She tried to avoid the collision...left skid marks and swerved. Cops seemed to believe her. But they do have to play it impartial.

Cops, in general, can be huge pricks. Especially if they think you were at fault or they think they can charge you with something.

The only time a cop was ever cool to me was a time this guy threatened to stab me, and his girlfriend called the police on him before he could attempt it. Hmmm, maybe I should start a thread.....after Physics class, that is.

call larry parker!! islms did it so i'm pretty sure he'll have some good input once he comes in here. the way i see it is it's worth paying a lawyer a 40% fee if they're able to net you out twice the payoff and less headache.

LOL, the cops were pretty nice to the girls. I've had problems with some of the dept. in the past, but it's getting better.

I'm curious about why someone would threaten you....you're just way too nice of a guy to want to hurt. :-P

yeah he's been on tv for quite some time. i used to work with him cause he was my boss's mentor in the foreclosure business that we did a few years ago.

I just talked to an atty and he thinks we screwed ourselves with her getting the surgery on he shoulder in the middle of it all. He didn't sound too helpful.

So I emailed the ins. company back with a counter offer.
Let's see what happens now.

We need to settle this ASAP, daughter needs a car.

Yeah, hobbit actually is right. You'll have attorneys begging you to let them take your case as soon as the report comes back. The attorney can sue the other driver's insurance company for repairs, medical bills, and punitive damages. The insurance company will go back and forth with him, but eventually, they will give up some cash on it, as long as there is no question that the other driver is at fault.

I'm way too large for most people to want to threaten as well, but that dosen't stop people sometimes. I'm not gonna back down from anybody, big or small. So I can have a tendancy to get mouthy with people that try to get in my face. One time I almost got into it with two guys in the electronics dept at Wal-Mart, they said the wrong thing to me, and I snapped. At that moment I didn't care if I got fired or whatever, all I cared about was the beating I was gonna deliver to these punks. It was right in front of the store managers too. They sent me upstairs for a "time out", and they called the cops and stuff. I told the two guys what time I got off work, if they wanted to finish it then. They never showed up. I find that most people in this world are all talk. When it comes down to the nitty gritty, they back off.

That's what I tell my kids. Most bullies are all talk and no action. My 16 yr old has boys scared of her because her abilitiy NOT to back down when she feels she's right. My son on the other hand is still learning, but he can't afford to get into any fights right now.

Big Red is coming home. Because it's up in the air of who's at fault, they said tow it somewhere else or pay the storage charges of $35/day. Now I just have to fight my HOA management company. bleh.

go to your own insurance co for help. they will cover everything if they determine it's the other persons fault and then subrogate. (which basically means they will get reimbursed from the other ins. co.)

....from a licensed insurance agent in 38 states...even though i dont esll ins. anymore thank ****ing god.

IF they find the other person at fault, they cover. IF not, I pay. We only have liability on that van.

Same ins. company for BOTH drivers.
