The matter is due to to the management group that the fighters are under contract to and The UFC. Zikin Entertainment, Which mostly works with The American Kickboxing Camp out of San Jose, California, refused to sign a deal stated earlier that would give The UFC lifetime rights to the fighters likenesses for Video Games.
Valasquez seems to be unwilling to sign. He will most likely be cut. As I've heard, Josh Koscheck will not be cut as of now. If he loses his upcoming fight to Yoshiyuki Yoshida he may be cut. And after his last minute replacement for Diego Sanchez, the company felt like they owed him one more fight. UFC contracts state that the company can cut you after a loss.
The deal states Zuffa would have lifetime exclusive rights to the fighters likeness, As of right now, the fighters were signed to an old deal which was non-exclusive.
Also interesting is that it states that if a fighter leaves for another promotion (Say, Strikeforce) and that promotion gets a deal, they could not have thier liknesses used for it. I'm not an Anti-Trust Laywer, but that just sounds shady right there.
