Mike Tyson Arrested in New York Brawl

NEW YORK - Mike Tyson was released from a Brooklyn police precinct Saturday afternoon, hours after his arrest on assault charges following a brawl with two men outside a hotel.

The former heavyweight champion, who was charged with assault in the third degree, a misdemeanor, walked silently past reporters standing outside the 84th Precinct in a driving rain. Fans of the boxer shouted "Mike! Mike!" as he was led out by police.


Tyson, who turns 37 on Tuesday, was arrested at 5:30 a.m. after a fight with two Pennsylvania men outside a hotel, police said. All three were guests at the hotel.


According to police, Samuel Velez, 31, of Reading, Pa., and Nestor Alvarez, 24, of Philadelphia, were with a woman outside the hotel when the fight began. One of the men used a metal pole grabbed from the lobby against Tyson, who was treated for minor cuts to his hands. He had his right hand bandaged when he left the police station.


A source close to the investigation said the two men started the fight with Tyson, adding that the boxer feared the men would hit him with the pole.


"They did instigate it," the source told The Associated Press. "They were harassing him, saying things to him. But Tyson was the one who threw the first punch."


Velez and Alvarez were charged with menacing in the second degree, menacing in the third degree and harassment, all misdemeanors, said a spokesman for Brooklyn District Attorney Charles J. Hynes. The men were arraigned early Sunday and entered pleas of not guilty to the charges, the spokesman said, and their next court date will be June 26.


One of the men and their female companion were treated for minor injuries at Bellevue Hospital, police said. Tyson was not taken to the hospital.


Shelly Finkel, adviser to the 36-year-old Brooklyn-born boxer, did not know any of the details of the confrontation.


"I don't know anything except what I heard this morning," Finkel said. "I'm in the process of trying to find out."


Finkel said he spoke to Tyson on Tuesday, and the boxer said he planned to travel to Phoenix.


Tyson, with a long history of legal trouble, was convicted of rape in 1992 and was sentenced to six years in prison. He served three years before being released on parole.


In a Fox television interview last month, Tyson said he was so angry about the conviction he wanted to rape his accuser, former beauty pageant contestant Desiree Washington, and her mother.


In 1997, he bit off a piece of Evander Holyfield's ear during a bout. Tyson's Nevada boxing license was suspended for a year, and he was fined $3 million. In 1999, he was released from a Maryland jail after serving 3 1/2 months for assaulting the two motorists.


Last year, he threw a punch at Lennox Lewis' bodyguard at a news conference announcing a fight between the two, setting off a brawl between Tyson and Lewis.

Well for one she has boyfriends she said that have raped her in the past because her father would get mad. People have reported that she was flirting with tyson all during that contest. She went into his limo at 2:00 a.m I think that means somebody wants to party. Plus she said before it happened she went into the bathroom. But there was a phone in the bathroom that she could have used to call for help. She said that he was touching her in his limo but agrees to go up to his hotel room when she is feeling like something is wrong. Yeah okay.

There was blood everywhere," said a worker at the scene of the melee inside the Marriott Hotel in downtown Brooklyn. "Imagine that iron fist hitting your skin."

The trouble began when a Philadelphia couple on their honeymoon and a friend returned to the luxury hotel at around 5:30 a.m. after a night of partying, police said.

As they entered, they spotted Tyson outside, reportedly leaving the hotel en route to Arizona to visit one of his four children.

Some hotel staffers said the fight began when the former heavyweight champ refused to give the trio an autograph.

Some witnesses blame the couple and their friend for hassling the boxer, mocking him for the tattoo around his eye. Police suspect the party-goers had been drinking.

According to cops, Samuel Velez, 31, of Reading, Pa., told Tyson his hands might be fast, but not speedier than a bullet. Then he gestured toward his waistband as if to pull out a gun, police said.



The trio then entered the hotel and Tyson followed them in. The pugnacious pugilist attacked Velez, punching him in the mouth and knocking him out, a police source said.

Velez's new bride, Thamara Ocasio, 27, at one point jumped on Tyson, cops said, but the boxer flung her away.

Then Velez's friend, Nestor Alvarez-Ramos, 24, of Philadelphia, came at Tyson with a metal stanchion, but Tyson knocked it out of his hand.

Alvarez ran behind the front desk, and Tyson jumped over the desk and began throwing punches.

The unsanctioned morning melee lasted longer than Tyson's last tiff - when he destroyed Clifford "The Black Rhino" Etienne on Feb. 23 in 49 seconds.

A hotel video camera captured the action, police said.

Cops arrived and immediately handcuffed the bad-boy boxer - whose hand needed a bandage - and took him to the 84th Precinct station house for questioning.

Tyson, who served three years in prison for a 1991 rape and 31/2 months for a 1999 assault, reportedly told cops he fought out of fear.

Cops later discovered a warrant against Velez for failing to appear in court on a 2001 drug charge. He also had been arrested for kidnapping in Brooklyn in 1991.

Released on a desk-appearance ticket for third-degree assault, Tyson stalked past an admiring mob and into a waiting SUV without comment. He is unlikely to face jail time, sources said.

The three friends were treated at area hospitals, and Velez needed stitches to his mouth, sources said.

Alvarez-Ramos and Velez were charged with menacing and disorderly conduct, both misdemeanors. Alvarez-Ramos was released on his own recognizance last night, while Velez was given $2,000 bail - but ordered held because of the outstanding warrants.

Customers at the hotel bar said Ocasio's brother passed around pictures of his sister with a bruised eye and bloody arm.

"We just hit the lottery," he reportedly crowed, bragging the family would sue Tyson.

Last night, Velez's younger brother, David, who arrived just after the fight, told The Post that his brother gave a different account of the brouhaha.

"[Alvarez-Ramos] approached [Tyson] outside to say hello," David Velez said. "[Tyson] said, 'Get the f- - - away,' so they said 'Forget about him' and walked into the hotel.

"Then Tyson came after them and said, 'You just f- - -ed with the wrong guy.' "

He said that's when they were attacked by Tyson, who is the Velez brothers' favorite fighter. "We've been watching him since he started fighting," said David, 29, who lives in Brooklyn. "[Samuel] used to joke, 'Imagine what it would be like to get hit by him.' "
