2 different plants...the leaves look almost the same

yes, two different species, although there is a lot of cross breeding in the mint family. If you had them fresh, you should be able to taste, smell, and feel the difference.

and you can't kill them....even if you run them over with the mower

Well, I don't normally go around masticating on fresh leaves off trees, so I guess I'll never truly understand.
