"My name is Howard Zelener and I am the attorney for KOTC. I have read your April 7, 2003 posting regarding Mr. Ambriz and KOTC. I have no intention of litigating this dispute in the media but I am compelled to correct several false statements contained in Mr. Ambriz’ story.
Mr. Ambriz has signed no less than 3 separate contracts with KOTC and none of them have been altered in any manner. On July 29, 2002, Mr. Ambriz signed a contract for his August 3, 2002 KOTC fight and agreed to compete in 2 additional fights for KOTC if he won that fight.
On December 7, 2002, Mr. Ambriz signed a contract for his KOTC fight that same day and agreed to fight in 2 additional fights for KOTC on February 21, 2003 and May 16, 2003.
On February 20, 2003, Mr. Ambriz signed a contract for his February 21, 2003 KOTC fight and agreed to fight for KOTC again on May 16, 2003. Mr. Ambriz also agreed that he would not participate in any other fights within the 28 days prior to the May 16th fight date.
The implication that KOTC “cosmetically altered” the agreements is both false and defamatory. KOTC is in possession of fully signed originals bearing Mr. Ambriz' signature and initials.
About 10 days ago, KOTC became aware that Mr. Ambriz had signed a contract with New Japan for a fight on May 2, 2003, in violation of his contractual obligations to KOTC. Rather than provoking a confrontation, KOTC very graciously offered to release Mr. Ambriz from his contractual obligations if he reimbursed KOTC for its out of pocket expenses to edit the Pay-TV commercials and to reprint the posters and fliers to remove Mr. Ambriz’ name and likeness from those promotional materials for the May 16th fight.
Mr. Luzzo, who is purportedly Mr. Ambriz’ new manager, was clearly notified that KOTC would not release Mr. Ambriz from his contractual obligations if he did not agree to the proposed reimbursement. Mr. Luzzo promised to have his attorney contact me today to work out the details of this settlement proposal. However, I never heard from Mr. Luzzo or his attorney.
After reading your story, it is apparent that Mr. Ambriz and his advisors have rejected KOTC’s attempts to informally and amicably resolve this dispute. Accordingly, I have been instructed to file a lawsuit against Mr. Ambriz, his advisors and New Japan. I will be pursuing breach of contract, interference with contract and defamation claims. Mr. Ambriz, his advisors and New Japan will be held responsible for the damages they have caused by blatantly ignoring Mr. Ambriz’ contractual obligations to KOTC."
